Can my child apply for maintenance?

 
 

There may be an advantage in your child making the application rather than you. For example, they may be entitled to help with legal costs while you are not.

Your child can only apply for maintenance if:
  • they are 18 or over; and
  • there was no order for periodical maintenance for the child immediately before their 16th birthday (or the order was set to terminate at age 16 or between 16–18 and he or she is applying to revive this order).
