Incapacity Benefit

Money during maternity and adoption factsheet

You may be entitled to Incapacity Benefit if you are unable to work (whether or not you have a job) due to your pregnancy and/or because you have recently given birth and you are not entitled to Statutory Maternity Pay or Maternity Allowance and you have paid or been credited with sufficient National Insurance contributions in the last three years before the current one. It is paid at a basic rate of £63.75 per week for 6 weeks before the expected week of childbirth and for 2 weeks after your baby is born.

You can also claim Incapacity Benefit if you are incapable of work and cannot claim Statutory Sick Pay and have paid or been credited with sufficient National Insurance contributions.

Apply on form SC1 available from your local Jobcentre Plus office.

If you are not entitled to Incapacity Benefit, claim Income Support.

Note: Incapacity Benefit will be replaced by the Employment Support Allowance (ESA) in October 2008. It is paid at a basic rate of £60.50 per week in your period of entitlement.
