As the parent with the day-to-day care of the child, you are the parent they are resident with, even thoughthey may spend nights away with their other parent.

Residence is usually decided between the parents of a child, in the vast majority of cases without any need for involvement from the courts and without a Residence Order needing to be made. If you cannot agree, ask for our factsheet Help with reaching agreements when a relationship ends. As a last resort you may need to apply to the court to decide - see Asking the court to decide where a child should live (below).
